The Code of Criminal Procedure, 1973 (CrPC): Section 125 of the CrPC allows for the provision of maintenance to wives, children, and parents who are unable to maintain themselves. This provision is applicable irrespective of religion and marital status.
The Hindu Marriage Act, 1955: Sections 24 and 25 of the Hindu Marriage Act allow for the award of maintenance pendente lite (during the pendency of legal proceedings) and permanent maintenance to spouses in Hindu marriages who are unable to maintain themselves.
The Hindu Adoption and Maintenance Act, 1956: This Act provides for the maintenance of dependents, including wives, children, and aged parents, by certain relatives, primarily applicable in cases of Hindu family relationships.
The Protection of Women from Domestic Violence Act, 2005: This Act provides for various reliefs, including maintenance, to victims of domestic violence. Section 20 of the Act allows for the grant of maintenance to the aggrieved party and dependent children.
The Muslim Women (Protection of Rights on Divorce) Act, 1986: Under this Act, a divorced Muslim woman is entitled to maintenance from her former husband, known as “iddat” maintenance, for the duration of the iddat period, as well as a reasonable and fair provision for her future maintenance.
The Indian Divorce Act, 1869: Applicable to Christians, this Act provides for the award of alimony or maintenance to wives in cases of divorce.
The Special Marriage Act, 1954: This Act allows for maintenance to be awarded to wives and children in cases of divorce or judicial separation between spouses married under this Act.
